1. Acceptance of Terms
By accessing or using the website at https://sitescale.dev (the "Site") or engaging SiteScale ("we", "us", or "our") for any services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or our services.
2. Services
SiteScale provides web design, development, SEO, and performance audit services for local businesses. The specific scope, deliverables, timeline, and commercial terms of any project are agreed separately in writing between SiteScale and the client prior to commencement of work.
Any free performance audit or initial consultation is provided at our sole discretion and does not create a binding obligation on either party to enter into a commercial engagement.
3. Intellectual Property
All content on this Site — including but not limited to text, design, graphics, logos, and code — is the property of SiteScale or its licensors and is protected by applicable intellectual property law.
Upon full payment for a completed project, and unless otherwise agreed in writing, the client receives a licence to use the final deliverables for the agreed purpose. SiteScale retains the right to display the work in our portfolio and marketing materials unless the client expressly requests otherwise in writing.
Any third-party assets, fonts, libraries, or frameworks used in a project are subject to their own respective licences.
4. Client Responsibilities
Where we are engaged for services, the client agrees to:
- Provide accurate and complete information required to deliver the project.
- Supply all necessary assets, content, and approvals in a timely manner.
- Ensure they have the legal right to use any content, images, or materials provided to us.
- Notify us promptly of any changes that may affect the scope of work.
5. Payment
Payment terms are as set out in the written agreement between SiteScale and the client. Unless otherwise agreed:
- A deposit may be required before work commences.
- Final payment is due upon project completion or delivery of the agreed deliverable.
- Late payments may incur interest at a rate permitted by applicable law.
We reserve the right to suspend or withhold delivery of work until outstanding payments are received.
6. Disclaimers
The Site and any free audits or recommendations are provided on an "as is" and "as available" basis without warranty of any kind, whether express or implied.
We do not guarantee that use of our services will result in specific business outcomes, rankings, traffic levels, or revenue. Results depend on a wide range of factors beyond our control, including but not limited to search engine algorithm changes, market conditions, and client actions.
7. Limitation of Liability
To the maximum extent permitted by law, SiteScale shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or our services, including but not limited to loss of profit, loss of data, or business interruption.
Our total aggregate liability in connection with any project or service shall not exceed the total fees paid by you to us in respect of that project in the three months preceding the event giving rise to the claim.
8. Confidentiality
Each party agrees to keep confidential any information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
9. Termination
Either party may terminate a project engagement with reasonable written notice. Upon termination, the client shall pay for all work completed up to the date of termination. We reserve the right to terminate our engagement immediately and without notice if the client is in material breach of these Terms or the agreed project terms.
10. Acceptable Use
You agree not to use this Site or our services to:
- Engage in any unlawful, harmful, or fraudulent activity.
- Submit false, misleading, or defamatory content.
- Infringe the intellectual property or other rights of any third party.
- Attempt to gain unauthorised access to our systems or data.
11. Third-Party Links
Our Site may contain links to third-party websites for informational purposes. We have no control over the content or practices of those sites and accept no responsibility for them. Visiting any third-party site is at your own risk.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
